General Terms of Service for the Fabrico platform.
Fabrico is operated by Fabrico Marketplace SNC, with registered office at Via Nuova 2, 6537 Grono, Switzerland.

1. Subject matter and definitions
These General Terms of Service (hereinafter "Terms") govern the use of the Fabrico platform, a digital marketplace dedicated to the sale of handmade artisan physical goods produced by Swiss artisans. By using the Fabrico app or website, you fully accept these Terms.
For the purposes of these Terms:
- Fabrico: the platform operator identified above, acting exclusively as an intermediary between Buyers and Sellers.
- Seller: a verified Swiss artisan who lists and sells their handmade products on the platform.
- Buyer: a registered user who purchases products through the platform.
- User: any person using the platform, whether as a Buyer or Seller.
2. Nature of the service
Fabrico is a marketplace for handmade physical goods. The platform facilitates the connection between Buyers and Sellers and provides the tools needed to list, discover, and purchase handmade products.
Fabrico is not a party to the sale contract, which is concluded directly between Buyer and Seller. Fabrico does not manufacture, own, or ship the products sold on the platform.
3. Eligibility requirements
To use Fabrico you must:
- Be at least 16 years old. Users aged 16–17 must obtain parental or legal guardian consent before making purchases, in accordance with Art. 19 of the Swiss Code of Obligations.
- Have the legal capacity to enter into binding contracts under Swiss law.
- To register as a Seller: be resident in Switzerland and have the capacity to conduct commercial activity.
- Maintain only one personal account per person.
4. Account, registration and verification
To purchase on Fabrico you must create an account by providing:
- Verified email address
- Legal first and last name
- Full shipping address
To purchase age-restricted products (alcohol), Buyers must complete the same identity verification via Stripe Connect used by Sellers. This verification confirms the Buyer's age (18+) and Swiss residency. Buyers without this verification cannot purchase products marked as age-restricted.
To register as a Seller you must also:
- Complete identity verification via Stripe Connect (KYC), which confirms identity, Swiss residency, and legal age.
- Accept the Stripe Connected Account Agreement.
The User undertakes to provide truthful information and keep it up to date, to keep their login credentials confidential, and to immediately notify Fabrico of any unauthorised access to their account by writing to info@fabrico.ch.
Fabrico reserves the right to suspend or delete accounts that violate these Terms.
5. User-generated content
Users may upload the following content to the platform:
- Sellers: product listings (descriptions, prices, categories), product images, cover image, featured images, profile photos.
- Buyers: profile photos.
Users retain all intellectual property rights over the content they upload. By uploading content to the platform, the User grants Fabrico a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute such content solely for the purpose of operating the platform (display in-app, search results, follower notifications, promotion of the product on Fabrico's official channels). This licence terminates upon removal of the content, subject to backup copies and operationally necessary copies.
The User represents and warrants that they hold all necessary rights over the uploaded content and do not infringe any third-party rights.
6. Prohibited content and behaviours
It is strictly forbidden to list, sell, or promote on the platform:
- Counterfeit products or products that infringe third-party intellectual property rights.
- Products not handmade by the Seller personally (resale, dropshipping, mass-produced goods).
- Goods or services illegal under Swiss law.
- Weapons, ammunition, explosives.
- Drugs, controlled substances, prescription medicines, supplements with therapeutic claims.
- Live animals.
- Hate speech, harassment, sexually explicit content, content promoting violence or self-harm.
- Content that exploits or endangers minors.
- Stolen goods.
- Personal data of third parties without their consent.
- Deceptive or fraudulent listings.
Permitted categories with restrictions (must comply with Swiss law and platform age restrictions):
- Alcoholic beverages (Ticino wines, grappa, spirits): the listing must be marked as age-restricted; purchase requires the Buyer to have completed identity verification via Stripe Connect, confirming age (18+) and Swiss residency. Buyers without such verification cannot add age-restricted products to their cart.
- Food and beverages: must comply with Swiss food law (LDerr); the Seller is responsible for the correct declaration of ingredients and allergens.
- Cosmetics: must comply with Swiss cosmetics regulations; therapeutic claims are not permitted.
Sellers acknowledge that they are responsible for the legal compliance of their products with the regulations applicable to their specific category.
7. Reporting, blocking and moderation
Fabrico operates an active moderation system to ensure a safe environment for all Users.
- Reporting: any User can report a listing, post, image, or Seller account via the report button available in-app. Reports are forwarded to Fabrico's moderation team.
- Blocking: any User can block a Seller. A blocked Seller's profile, listings, and posts will no longer appear in the feed, search results, or suggestions for the User who blocked them.
- Review times: Fabrico commits to human review of reported content within 24 hours of receiving the report.
- Actions: content that violates these Terms is removed. The relevant Sellers are notified. Serious or repeated violations may result in suspension or permanent termination of the account, at Fabrico's discretion.
- Appeal: Sellers may appeal a removal by writing to info@fabrico.ch within 14 days of notification.
- Cooperation with authorities: illegal content is reported to the competent Swiss authorities where required by law.
8. Purchases and payments
- All prices are quoted in Swiss Francs (CHF) and include VAT where applicable.
- The sale contract is concluded directly between Buyer and Seller; Fabrico is not a party to the contract.
- Payments are processed by Stripe Payments Europe Ltd., a third-party payment service provider.
- Physical goods marketplace: Fabrico operates exclusively as a marketplace for the sale of handmade physical artisan goods. The use of Stripe as the payment processor is compliant with Google Play Payments policies and Apple App Store guidelines for commerce in physical goods.
- Fabrico does not store credit card data.
- The purchase is completed upon payment confirmation.
- Shipping costs, where applicable, are clearly shown before order confirmation.
9. Fabrico's role as a marketplace
- Fabrico facilitates the connection between Buyers and Sellers but is not a party to the sale contract.
- Fabrico charges a 4% commission on each successfully completed transaction.
- Payments to Sellers are disbursed via Stripe Connect, according to the standard service timeline.
- The identity of every Seller is verified via Stripe Connect KYC, which confirms Swiss residency and legal age.
10. Shipping and delivery
- Shipping is organised and managed directly by the Seller.
- The Buyer's name and shipping address are shared with the Seller solely for the purpose of fulfilling the order.
- Sellers are required to ship products within the timeframes stated in the listing.
- Tracking information, where available, is communicated via the app.
11. Returns, refunds and cancellations
- Swiss law does not provide a statutory right of withdrawal for distance sales of physical goods.
- Each Seller defines their own return policy, visible on the listing page. Buyers are advised to read it before purchasing.
- Refund request: the Buyer may request a refund through the dedicated in-app function if the product is defective, damaged during transport, or materially different from the description.
- Cancellation by the Seller: the Seller may cancel an order before shipping, stating the reason; in such case the Buyer is automatically refunded in full.
- Undelivered order: the Buyer may report an undelivered order through the dedicated in-app function; Fabrico will act as a mediator between the parties.
- Fabrico may, at its discretion, mediate disputes but does not guarantee any particular outcome.
12. Push notifications
Fabrico sends push notifications relating to:
- Order updates: order confirmation, shipment, delivery, cancellation, refund status. These notifications are an integral part of the service.
- New products from followed Sellers: when a Seller you follow publishes a new listing. These notifications are optional.
Push notifications can be disabled at any time from your device settings (iOS: Settings > Notifications > Fabrico; Android: Settings > Apps > Fabrico > Notifications). You can also manage notifications by category from the in-app settings.
13. Account deletion
- Users may delete their account at any time through the dedicated in-app function.
- Deletion is blocked as long as there are open orders (orders that are open, paid but not shipped, in transit, or in active dispute).
- Upon deletion, Fabrico permanently removes: profile data (name, email, address, profile photo, cover image, featured images), authentication credentials, follow relationships, push notification tokens, and block lists.
- Fabrico retains for 10 years data relating to completed orders (order ID, date, amount, names and addresses of the parties) as required by Arts. 957–958f of the Swiss Code of Obligations on accounting obligations. This data cannot be deleted at the User's request.
- Payment data managed by Stripe is subject to Stripe's retention policies and Swiss financial regulations.
Users who do not have access to the app can visit the Delete Account page to request account deletion.
14. Intellectual property
- The Fabrico brand, logo, design, code, and platform content are protected by copyright and trademark law. Unauthorised use is prohibited.
- Sellers and Users retain ownership of their product images, descriptions, and other uploaded content.
- Reports of intellectual property infringement may be sent to info@fabrico.ch, providing sufficient information to identify the work and the alleged infringement; Fabrico will act promptly on credible reports.
15. Limitation of liability
- Fabrico acts as an intermediary and is not liable for: quality, conformity, safety, or legality of products (beyond removing reported content in violation), shipping, delivery delays, or disputes between Buyer and Seller.
- Fabrico provides the platform "as is" without warranties beyond what is required by Swiss law.
- Fabrico's liability is limited to the maximum extent permitted by Swiss law.
- Force majeure: Fabrico is not liable for failures caused by events outside its reasonable control.
- Nothing in this clause limits liability for fraud or gross negligence, where such limitation is prohibited by Swiss law.
16. Changes to the Terms
- Fabrico reserves the right to modify these Terms. Material changes are communicated via in-app notification and/or email at least 14 days before they take effect.
- Continued use of the platform after the effective date constitutes acceptance of the new Terms.
- Users who do not wish to accept the new Terms may delete their account.
17. Governing law and jurisdiction
- These Terms are governed by Swiss law.
- For any dispute arising from the use of the Fabrico platform, the exclusive court of jurisdiction is that of Lugano, Canton Ticino, Switzerland.
- Mandatory consumer rights under Swiss law remain unaffected.
